1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you ("User") and OxyLab Systems ("we," "us" or "our"), concerning your access to and use of the OxyLab POS software. By accessing the services, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions.
2. Service Scope & Setup
Account Provision: We provide you with an account on our hosted software platform.
Custom Domains: Setting up the software on your own custom domain or subdomain is available but will incur additional setup and maintenance costs.
Our Responsibility: We are solely responsible for the software architecture, stability, server uptime, bug fixes, and feature updates.
3. Data Responsibility & Backups
Important Disclaimer regarding your data.
While we perform daily backups of our server infrastructure to ensure system continuity, we do not accept responsibility for your specific business data.
User Responsibility: You are responsible for your own data. We highly recommend and advise all users to regularly export and backup critical data, including but not limited to: Customer Lists, Product Lists, Transaction Logs, and Sales Reports.
Unpaid/Expired Accounts: We do not guarantee data preservation for unauthorized, unpaid, or expired user accounts. If your subscription expires or is terminated, your data may be permanently deleted.
4. SMS Policy & Prohibited Activities
The use of our SMS notification features is subject to strict regulation.
You agree not to send spam, phishing links, illegal content, or unauthorized marketing messages via our SMS gateway.
Violation Consequence: Sending SMS messages that break local or international telecommunication rules will result in immediate account suspension and may lead to legal action against you.
5. Payment and Subscriptions
We bill you through an online billing account for purchases of our services. You agree to pay all charges at the prices then in effect for your purchases. Failure to pay may result in immediate loss of access to the software and data.
6. Limitation of Liability
In no event will we be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including loss of data, lost profit, lost revenue, or other damages arising from your use of the service.
